Lakemont Shores POA

     My husband and I own property in a community called Lakemont Shores.  It is ran by a  POA.  This community is on the Grand Lake of the Cherokees, outside of Disney (Eucha), Oklahoma. Not all properties are right on the lake front.  Some are about 2 miles from the lake. It began as the Lakemont Shores Community and Bay Club back in the early 70s.  In about 1978 the Bay Club part pulled out.  The community and property was bought out by different Land Companies, I do believe twice.
     The private community and club had all sorts of amenities for the members and families to use free of charge. If you owned property in the community and club, the swimming pools, paddle boats, tennis court, basketball court, putt putt golf, driving range to name a few, was free to the membership and their families. The Bay Club part left in about 1978 and later it became the Lakemont Shores POA. The POA has a nine member board that controls the community, hires maintenance workers, office manager, keeps up the roads, dock, cafe, marina, bathhouses and laundromats in good repair.
     Back in 2015, 16 additions in the community signed a petition to be de-annexed from the POA and no longer be under the POA rules.  The POA board voted and agreed to let the additions be de-annexed from the POA. Now they are in court to see if the de-annexation was done legally.
     The POA has begun billing the property owners of those additions to cover unpaid fees to the POA.  The POA is in such a mess now.  Unpaid IRS and county taxes for years.  Not enough employees.  The place looks run down and what is left of the amenities which is very slim, are not kept in good repair and the roads are not being maintained.  Many want there to no longer be a POA.  But It was brought to my attention that without a POA to enforce rules, the place could become worse.  Trashier properties, run down ones, which is already happening.  People having chickens and hogs.  Chickens not so bad, but hogs, no thanks.
      Become aware of what is going on with Lakemont Shores POA.  Right now the POA doesn't have a full board of directors.  There are only six of a nine member board on the board at this time. Others have resigned.  Sam Taylor was seated on the board without an election.  President Robbie Biles term of office is up.  There is an election going on right now. You should have received ballots.  Actually you should have received ballots twice.  The first time the name of one of the people running for a spot on the board was misspelled. Also there were two columns of names and you were to pick one from each list to put two new people on the board.
     The POA voted on a by-law change.  The board now only has to have 5 members to be a legal governing board.  I didn't think the POA had a quorum to even have a meeting, much less vote on a by-law change.  I need to read back over the by-laws.
     Another concern I have is how legal is the POA and the board at this time?  The POA hired a General Manager without a full board.  They are in court and being sued by some because they are trying to collect back fees from property owners in some of the 16 de-annexed additions.  Plus an injunction is in place to remove the POA and have a receivership put it the place of the POA.  I don't understand why a judge hasn't ruled the POA illegal and shut them down.  Seems like they shouldn't be able to collect any fees or hire people, when they are being sued.  Too many court cases going on at once.  It can get very confusing.
     If you do not believe what I am saying is true, check it out for yourself.  Others have and I have taken what I know from what others have searched out and posted proof on the Lakemont Defenders Page on facebook.  Until I found that page and joined, I didn't have any idea how bad things are at Lakemont.  I know back in about 2009 most of the board resigned except for the President Fred Hammock.  They had to seat a new board.  Many have said how crooked the last board was and how crooked this one that is in place now.  I for one have no idea.  I do not live there year round.
